Company Agreement

ONS Moments - Photography Company Agreement · Electronic Agreement · ONS-MOM-PA-2026-09-v4

Every photography company signs this agreement electronically when it creates its account. The signed copy, with the date and the signature, is kept with the account.

01Platform role

ONS Moments is a technical platform for event photo delivery, galleries, camera uploads and related tools. ONS does not perform the photography service and is not responsible for the provider's photography work or the rights connected to that work.

02Authority and accurate data

The photography company confirms that the person creating and signing the account is authorized to act for it and that all submitted account and event information is accurate and current.

03Account and access

Account, team and FTPS credentials may be used only by the photography company and its authorized event staff. The company must protect credentials and report suspected unauthorized access promptly.

04Coverage activation and credits

Coverage activates immediately when the photography company has sufficient photo credits or is financially exempt under ONS settings. QR and upload details appear after activation. Any offers or free credits are subject to what is shown in the account at the time of use, without any guarantee of a permanent or recurring free trial.

05Event information

The company must verify the event name, date, start time and other information entered in ONS Moments and is responsible for errors in the information it submits.

06Upload period

The standard upload period starts at the recorded event start time and lasts seven full days (168 hours). Uploading and event-specific access stop automatically afterwards, unless ONS approves a different period for the company or event through the platform settings.

07Photo and content rights

The company confirms it has the permissions and rights required to capture, upload, process and deliver event media and will not upload unlawful or unauthorized content.

08Guest notice

The company must give clients and guests appropriate notice about photography, gallery access, privacy options and any optional face-search feature used for the event.

09Viewing without face search

Where the gallery is configured for general viewing, guests can view published event media without being required to create a face profile.

10Optional face search

Face search is optional and may be used only when enabled for the event and after any legally required notice, consent, approval or licence. A match is a convenience feature and is not proof of identity.

11Consent and withdrawal

When face search is used, the system may record notice and consent information. A guest may refuse the optional feature and may use available withdrawal or deletion controls, subject to applicable law.

12External processing

The service may use contracted cloud, hosting, storage, email and image-processing providers, including providers outside Bahrain, subject to applicable legal requirements and required approvals.

13Retention and deletion

The default retention period for event photos is thirty days under the service settings. ONS may approve a different period for a specific company or event. After this period, photos are deleted or become unavailable according to the service process, with any scheduled operational notice before deletion, unless the law requires a different retention period.

14Technical security

ONS uses reasonable technical controls such as HTTPS, access controls, temporary links and operating logs. The photography company must use trusted networks and approved credentials for camera and FTPS access.

15Fees and payment

Photo-credit packages, gallery extensions and team-member purchases are paid securely inside ONS Moments through an approved payment gateway. Creating a coverage does not require a separate event fee. Each uploaded original photo consumes one photo credit from the company’s shared balance; edited photos never consume photo credits.

16Team members

The account owner may add authorized team members. Each new paid team member is a one-time purchase at the price shown in the app. The owner controls event permissions and remains responsible for team use of the account.

17Cancellation and refunds

Cancellation and refund rights follow the offer shown for the purchase, any applicable commercial agreement and mandatory law. No automatic refund applies unless expressly stated or legally required.

18Taxes

Each party is responsible for taxes and value-added tax connected to its own fees and services under applicable law.

19Complaints and support

The photography company handles photography-quality and client-service complaints relating to its work. ONS provides technical support for the platform. The parties cooperate on legitimate technical, privacy and regulatory requests.

20Confidentiality

Both parties must protect non-public event information, prices, account data, documents and access credentials and disclose them only when necessary to provide the service or when legally required.

21Intellectual property

Brands, photographs and other content remain owned by their respective owners. The company grants ONS the limited technical rights needed to store, transmit, display and process content to provide ONS Moments.

22Subprocessors

ONS may use technical and infrastructure providers subject to appropriate contractual, security and disclosure requirements.

23Suspension and termination

ONS may suspend an account, team member or event for security concerns, non-payment, material breach, unlawful use or a competent-authority request. Existing obligations continue until properly closed.

24Limitation of liability

ONS does not guarantee uninterrupted availability, perfect network delivery or perfect face-matching accuracy and is not responsible for photography work or events outside its reasonable or legal control.

25Amendments, law and jurisdiction

ONS may update this agreement for legal, security or operational reasons and may require acceptance of a new version when a change is material. This agreement is governed by the laws of the Kingdom of Bahrain, and the courts of Bahrain have jurisdiction after reasonable efforts at amicable resolution.

26Electronic signature

Entering the authorized signatory details, confirming acceptance, drawing a signature and submitting the form creates an electronic acceptance record. The signatory confirms that they have read and understood this agreement, are authorized to accept it for the photography company and agree that the signature and acceptance record evidence that consent.
